“Disappointed but Undeterred:” Air Alliance Houston Responds to Judge’s Ruling in EPA Funding Lawsuit

Last Friday, a D.C. District Court judge dismissed a legal challenge brought by a national coalition of Environmental Protection Agency (EPA) Environmental and Climate Justice (ECJ) Program grantees whose grants were arbitrarily terminated due to the administration’s anti-justice agenda. Air Alliance Houston was a named plaintiff in the case.

In response, Jennifer Hadayia, Executive Director of Air Alliance Houston, issued the following statement: 

“We are certainly disappointed by the judge’s decision, but we can’t afford to give up. Too many Houstonians are suffering from the health impacts of air pollution, and they deserve to have a voice. The work we have planned in this grant with our partners fundamentally changes the balance of power toward that goal, and we remain undeterred in our efforts.” 

The Air Alliance Houston project, called AirMail Gulf Coast, supports a regional effort involving four community-based partners across 10 Texas counties, to better notify and inform communities in regards to pollution permitting, rules, regulations, and other key environmental decisions that directly affect their health. The project was selected for funding under the Environmental and Climate Justice Community Change Grant (CCG) Program created by the Inflation Reduction Act (IRA) under Clean Air Act (CAA) Section 138. 

Earthjustice, Southern Environmental Law Center, Public Rights Project, and Lawyers for Good Government filed the challenge on behalf of ECJ grant recipients, along with a preliminary injunction and class action certification, to seek the nationwide restoration of the grants.
